Terms of Service

Effective date: October 6, 2026Last updated: October 6, 2026

These Terms of Service ("Terms") apply to your use of the website at https://bakersforge.design (the "Site"). Please read them. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who we are

The Site is operated by Anthony Baker, an individual doing business as Baker's Forge, a sole proprietorship based in Preble (Cortland County), New York, USA, serving the Syracuse area ("Baker's Forge," "we," "us," or "our").

You can reach us at anthony.baker@bakersforge.design.

2. Using the Site

You're welcome to browse the Site, read about our services, look at our sample work, and contact us. When you use the Site, please don't:

  • Break the law or help anyone else break it.
  • Send spam, junk messages, or anything harmful (like malware) through our inquiry form or email.
  • Try to hack, overload, scrape at scale, or interfere with the Site or the systems that host it.
  • Pretend to be someone else, or submit information that isn't yours to share.
  • Copy or reuse our content in ways these Terms don't allow (see Section 4).

We may block access to the Site or ignore messages from anyone who misuses it.

3. Project work is covered by a separate agreement

The Site describes our services, starting prices, process, timelines, payment terms, and revision policies. That information is there to help you understand how we work. It is not an offer or a contract.

Any design, branding, website, development, or retainer work we do for you is governed by a separate written proposal and client service agreement that we both sign (the "Client Agreement"). The Client Agreement sets out the actual scope, price, schedule, payment terms, deposit and refund terms, revisions, ownership of deliverables, and other project details.

If anything on the Site (including our FAQ or pricing section) conflicts with your signed Client Agreement, the Client Agreement controls. Prices, packages, and turnaround times on the Site are starting points and can change at any time; they don't apply to you until they're in a proposal you've accepted. Sending us an inquiry doesn't create a client relationship or obligate either of us to anything.

How we work. Baker's Forge is a lean studio that uses software tools, including artificial intelligence (AI) tools, as part of its design and production process. Anthony Baker personally handles client communication and reviews and approves all work before it's delivered. The Client Agreement will describe how this applies to your project.

4. Our content and intellectual property

Unless stated otherwise, everything on the Site, including text, graphics, logos, the Baker's Forge name and marks, page designs, images, mockups, code, and the overall look of the Site, is owned by or licensed to Baker's Forge and is protected by copyright, trademark, and other laws.

You may view the Site and print or save a page for your own personal, non-commercial use (for example, to share it with a business partner while you decide whether to hire us). Otherwise, please don't copy, modify, distribute, sell, or create works based on our content without our written permission.

Fonts and certain other elements of the Site are provided by third parties under their own licenses.

5. Our portfolio and sample work

The "work" or portfolio section of the Site shows samples of what we do.

  • Concept projects. Some or all of the projects shown are self-initiated concept projects for fictional brands, not paid client work, and are labeled that way. Any brands, people, prices, products, and figures shown in those samples are fictional. Any resemblance to a real business is unintentional.
  • Client work. If we show work we created for a real client, we do so under the terms of that client's Client Agreement. If you're a client and want your project removed from our portfolio, email us and we'll take it down within a reasonable time.
  • No reuse. Portfolio pieces are shown to demonstrate our skills. You may not copy or reuse them for your own business.
  • Results vary. Samples show the kind of work we can produce. They aren't a promise that your project will look the same or achieve any particular business result.

If you believe something on the Site infringes your rights, please contact us at anthony.baker@bakersforge.design with details and we'll look into it promptly.

6. Disclaimers

We work hard to keep the Site accurate and available, but we provide it "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, about the Site, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't promise that the Site will always be available, error-free, or free of viruses or other harmful components.

Information on the Site is general information about our services. It isn't legal, financial, or business advice.

Any warranties or commitments for project work are only those written into your Client Agreement.

7. Limitation of liability

To the fullest extent the law allows, Baker's Forge and Anthony Baker will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business opportunities, arising out of or relating to your use of (or inability to use) the Site, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for any claim arising out of or relating to the Site or these Terms is limited to one hundred U.S. dollars (US $100).

This section applies only to your use of the Site. Liability for project work is governed by your Client Agreement. Some places don't allow certain limits on liability, so some of these limits may not apply to you.

8. Links to third-party sites and services

The Site may link to, or rely on, websites and services run by other companies (for example, our hosting provider or font provider, or sites we link to). We don't control those third parties and aren't responsible for their content, policies, or practices. Visiting a third-party site is at your own risk, and its own terms and privacy policy apply.

9. Governing law and disputes

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules.

Talk to us first. If you have a dispute with us about the Site or these Terms, please email us at anthony.baker@bakersforge.design and describe the issue. We'll try in good faith to resolve it informally.

Mediation. If we can't resolve it within 30 days after your message, either of us may request non-binding mediation with a mutually agreed mediator in Cortland County or Onondaga County, New York, or remotely by video, with the mediator's fees shared equally. Neither of us will file a lawsuit until mediation has been attempted or 60 days have passed since the mediation request, whichever comes first. Either of us may still bring a claim in small claims court, or ask a court for emergency relief to protect intellectual property, at any time.

Courts. Any lawsuit arising out of or relating to these Terms or the Site will be brought only in the state courts located in Cortland County, New York, or the United States District Court for the Northern District of New York, and you and we consent to the jurisdiction of those courts.

Disputes about project work are handled under the dispute process in your Client Agreement, which follows the same steps.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and change the "Last updated" date above. Changes apply from the time they're posted. If you keep using the Site after that, you accept the updated Terms.

11. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these Terms right away, we haven't waived our right to enforce it later. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site (project work is covered by your Client Agreement). You may not transfer your rights under these Terms; we may transfer ours, for example if Baker's Forge is reorganized as a company or sold.
